Buyer Terms and Conditions

1. BTF Auctions facilitates online auctions of a range of goods on behalf of third-party sellers via its website (https://btfauctions.com.au/). In doing so, BTF Auctions utilises a white label online auction platform provided by TBIT Pty Ltd t/as Webtron.oa. All goods auctioned are on consignment and BTF Auctions is not the owner or seller of any of the goods listed for auction.

2. A 16% buyer’s premium is added to the final knockdown price of all successful bids and is payable to BTF Auctions. The total price payable includes the knockdown price, the buyer’s premium, and any applicable taxes or charges (‘Total Payable Price’).

3. All items are sold ‘as-is’. BTF Auctions does not warrant or guarantee the condition, authenticity, merchantability, or fitness for a particular purpose of any item sold.

4. Buyers are responsible for inspecting items during designated inspection times listed on the auction website (https://btfauctions.com.au/) before placing bids.

5. While BTF Auctions takes reasonable steps to ensure accurate descriptions, all item details and condition reports are guides only. Buyers must conduct their own inspections and investigations. BTF Auctions accepts no responsibility for inaccuracies in descriptions or condition reports.

6. To participate in an auction, buyers must complete registration via BTF Auctions’ website. BTF Auctions may require identification or additional information from prospective buyers. All personal data is stored in accordance with applicable privacy laws.

7. Bids can only be placed online through BTF Auctions’ website (https://btfauctions.com.au/).

8. BTF Auctions may at its absolute discretion accept or reject bids, withdraw items, and divide or combine lots prior to or during any auction.

9. By placing a bid, the bidder agrees to purchase the item at that bid price if it is accepted as the winning bid.

10. The highest accepted bid at the end of an auction is the winning bid. Risk in the goods passes to the buyer at the end of the auction if their bid is the winning bid. Title does not transfer until the Total Payable Price is received in full by BTF Auctions.

11. BTF Auctions bears no responsibility for loss or damage to goods prior to, during or after the auction has concluded.

12. Payment of the Total Payable Price must be made within 24 hours of buyers being notified that their bid is the winning bid and an invoice being issued for payment. Payment options are described in invoices issued to buyers following a successful bid and include credit/debit card, EFT, Stripe, Apple Pay and Google Pay. Upon receipt of full payment by BTF Auctions, title to the goods transfers to the buyer.

13. Failure to make full payment on time in accordance with these terms constitutes a breach of these terms and results in forfeiture of the goods purchased by the buyer, which may be sold to the next highest bidder or at a later auction. The seller and/or BTF Auctions may recover any losses sustained as a consequence of a breach of these terms by the buyer in any Victorian Court or Tribunal of competent jurisdiction.

14. No goods will be released until full payment has been received by BTF Auctions.

15. Goods sold at auction may be stored by BTF Auctions on behalf of the seller or remain in the possession of the seller. Buyers are solely responsible for collecting their purchases from BTF Auctions, or from the seller. All transport arrangements and costs are the responsibility of the buyer.

16. Collection must occur at the seller’s designated location or at BTF Auctions business premises (410 Barrabool Road, Ceres VIC) at designated times specified on the auction website (https://btfauctions.com.au/) or by prior arrangement between buyer and seller. If goods are to be posted or couriered to the buyer this shall be arranged between the buyer and seller and shall be at the buyer’s expense.

17. Items not collected within three (3) business days of the auction will incur a storage fee of $25 (incl. GST) per day. If uncollected after 14 days, it is hereby agreed that ownership in the goods shall transfer to BTF Auctions and the goods may be sold with all proceeds of the sale retained by BTF Auctions, or disposed of at the buyer’s cost, with no liability to BTF Auctions or the seller.

18. Where a buyer purchases a lot, the buyer must collect and remove the entire contents of the lot. No separation, sorting, or partial collection is permitted. Failure to remove the entire lot may result in additional handling or disposal fees.

19. BTF Auctions is not responsible for any discrepancies, non-performance, or disputes between buyers and sellers.

20. All sales are final. No refunds or returns will be issued unless required by law.

21. In case of a dispute between buyer and seller, the parties (i.e. the buyer and seller) agree to meet in person or via audio visual link within 14 days of written notice being given by one party to the other to attempt to negotiate a resolution of their dispute. If unresolved, the matter may be brought before a Victorian court or tribunal.

22. These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of Victorian courts and tribunals.
